Federal Court Orders Release of Abrego Garcia from ICE Custody
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.
The case originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to face alien smuggling charges, he was detained in federal detention.
In her order, the court noted that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."
Background of the Case
The court challenge involve disputed claims. Whereas the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing criminal case in the state of Tennessee.
Conditions of Freedom
The court, who was overseeing his challenge to removal in a federal court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.
This decision represents a notable development in a complex immigration battle involving allegations of wrongful detention and disputed gang associations.
